Legal grounds for using a polygraph at a private company

In today’s business environment, many companies face the question: is it legal to use a polygraph (lie detector) in a private organisation? Especially when it comes to staff screening, internal investigations or assessing employees’ integrity. To use a polygraph properly in a company’s operations, it is important to understand its legal status, the grounds for its use and the restrictions under Ukrainian law.

Need a test rather than theory? Take the VerifEye online test — from 2,500 UAH (≈ €50), with no office visit — or calculate the cost of a polygraph test.

📌 What a polygraph is and whether its use is prohibited

A polygraph (lie detector) is psychophysiological equipment that records a person’s reactions to a series of questions in order to assess the sincerity of the answers. This approach is widely used in the private sector for:

  • assessing candidates during hiring;
  • internal investigations;
  • screening staff with access to critical information.

Under current legislation, the use of a polygraph in Ukraine is not expressly prohibited. This is confirmed by the general principles of the Constitution of Ukraine, which guarantee human rights but contain no direct prohibition on the use of a polygraph. More details, with links to the laws, are in the article “Polygraph law in Ukraine”.

📜 The Constitution of Ukraine and the voluntary nature of testing

The main legal restrictions on the use of a polygraph follow directly from the Constitution of Ukraine:

✔ Article 28 of the Constitution of Ukraine

no one may be subjected to medical, scientific or other experiments without their voluntary consent.

This means that, whether it is a pre-employment test or one carried out during an internal investigation, a polygraph may only be used with the person’s voluntary written consent.

✔ Article 32 of the Constitution of Ukraine

protects the right to privacy and personal data and prohibits collecting information without consent.

This further underlines that a polygraph test must not intrude on an employee’s private sphere.

⚖️ Using a polygraph when hiring

Ukrainian law does not make a polygraph test mandatory when applying for a job. However, an employer has the right to offer such a test if:

  • this is clearly stated in the company’s internal policy;
  • the candidate/employee has given voluntary written consent;
  • the procedure does not violate the employee’s other rights.

To be legally sound, it is recommended to include the procedure for using a polygraph in the company’s internal documents (policies, job descriptions, etc.).

🧑‍⚖️ Using a polygraph during internal inquiries

Besides hiring, a polygraph can be used:

  • during internal investigations;
  • when there is suspicion concerning identified violations;
  • to assess employees who have access to important information.

In doing so, it is important to observe the basic principles of law:

  1. voluntary participation;
  2. no pressure on the employee;
  3. confidentiality of personal data.

📄 The regulatory framework and its limitations

Although the polygraph is not prohibited by law, there is no separate law regulating its use in Ukraine.

Legal literature and academic publications stress that the legal basis for using a polygraph is formed by:

  • the Constitution of Ukraine;
  • the general principles of personal data protection;
  • companies’ internal corporate documents.

In particular, studies note that the absence of a special law on the polygraph in Ukraine creates a certain legal uncertainty but does not prohibit its use on agreed terms.

🧾 Requirements for conducting tests

For the lawful use of a polygraph at a company, it is important to:

  • obtain the written voluntary consent of the person being tested;
  • ensure the confidentiality of the information obtained during the test;
  • have internal procedures and policies governing the use of the polygraph.

The polygraph examiner’s work must be backed by appropriate skills and certification, since competent interpretation of the results is critical to the legitimacy of the conclusions.

🧠 Case law and the polygraph

Although the polygraph generally has no direct status as evidence in civil or criminal cases, its results can be used as indicative information or as an additional argument within the body of evidence.

This underlines that test results should not be the sole ground for dismissal or disciplinary action without other corroborating evidence.

📝 Conclusion

To sum up:

  • Using a polygraph at a company in Ukraine is not prohibited by law.
  • Its use is permitted only with the voluntary written consent of the person concerned.
  • The legal basis rests on the Constitution of Ukraine and the principles of personal data protection.
  • For the polygraph to be used lawfully, it is important to have internal company procedures and policies.

Using a polygraph correctly not only strengthens personnel security but also helps a company make well-founded management decisions without breaking the law or violating employees’ rights.
